Kovel, this doctrine extends attorney-client privilege to non-lawyers—such as accountants or translators—who act as an agent of the attorney to assist in the provision of legal advice. In addition to tactical prompting, firms are increasingly steering clients away from public, consumer-grade AI. Instead, they are recommending "closed" enterprise-grade systems. These platforms typically offer contractual guarantees that user data will not be used to train the model and will not be accessible to the service provider’s employees.
